END-USER LICENSE AGREEMENT
IMPORTANT – READ CAREFULLY: This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) later referred to as “LICENSEE” and MiniTool® Software Ltd. later referred to as “MiniTool Software” for the software product MiniTool Screen Recorder later referred to as “SOFTWARE”.
By installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not purchase, install or use the SOFTWARE. Installing and using the SOFTWARE signifies acceptance of these terms and conditions of the license.
The MiniTool Software may have patents, patent applications, trademarks, copyrights, or other intellectual property rights covering subject matter in this document. The furnishing of this document does not give you any license to these patents, trademarks, copyrights, or other intellectual property.
Copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect the SOFTWARE. The SOFTWARE is licensed, not sold.
1. GRANT OF LICENSE
This EULA grants LICENSEE the following rights:
LICENSEE may use this SOFTWARE. “Use” of the SOFTWARE means that LICENSEE has loaded, installed or run the SOFTWARE on to a workstation, server, computer or virtual machine. (later referred to as “computers” or “computer”).
LICENSEE may use the SOFTWARE on computer owned or leased by the LICENSEE only.
LICENSEE may use this SOFTWARE in compliance with all applicable laws and not for any unlawful purpose. Without limiting the foregoing, use, display or distribution of this SOFTWARE together with material that is pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, promoting hatred, discriminating or displaying prejudice based on religion, ethnic heritage, race sexual orientation or age is strictly prohibited.
2. EDITION, LICENSE TYPE and LIMITATION
MiniTool Screen Recorder Free Edition is for private, non-commercial, home computer use. LICENSEE can install/use it on computers without a license key.
3. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
LICENSEE may not reverse engineer, recompile, and disassembly, modify, translate the SOFTWARE and make any attempt to discover the source code of the SOFTWARE.
LICENSEE may not transfer, sell, re-sell, offer for sale or distribute the SOFTWARE. – The sale of or distribution of copies of this SOFTWARE is strictly forbidden. It is a violation of this EULA to sell, loan, rent, lease, borrow, or transfer the use of copies of MiniTool Software except if it’s permitted by the terms and/or conditions of a separate agreement signed by MiniTool Software.
4. DISCLAIMER OF WARRANTY
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE DISTRIBUTED and SOLD “AS IS” AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.
ADDITIONALLY, THE LICENSEE MUST COMPLY WITH THE USER AGREEMENT OF THE RESPECTIVE VIDEO WEBSITE WHEN RECORDING VIDEOS.
LICENSEE USES THE SOFTWARE AT HIS OWN RISK.
5. COPYRIGHT
All title and copyrights in and to the SOFTWARE (including but not limited to any images, photographs, animations, video, audio, music, and text incorporated into the SOFTWARE), the accompanying printed materials, and any copies of the SOFTWARE are owned by MiniTool or its suppliers. The SOFTWARE is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE like any other copyrighted material, and may not remove or conceal any proprietary notices, labels or marks from the Software.
USE OF SCREEN/AUDIO RECORDING
LICENSEE SHOULD RESPECT COPYRIGHT AND ONLY TAKE VIDEO OR AUDIO RECORDINGS AS PERSONAL USE. NO COMMERCIAL DISTRIBUTION IS PERMITTED. YOU ARE RECOMMENDED TO GET THE OWNER’S PERMISSION BEFORE RECORDING ON A VIDEO OR AUDIO FILE.
Fair use doctrine may allow limited recording usage for non-commercial purposes like criticism, comment, news reporting, education, scholarship, or research. Factors such as the amount of the copyrighted work used, the nature of the use, and the effect on the potential market for the original work are carefully considered.
However, popular social platforms (YouTube, TikTok, Instagram, Facebook, X, Netflix, etc.) often have strict terms of service prohibiting screen recording and redistribution of their content without authorization. Therefore, it’s crucial to check out the specific terms and conditions of these platforms to avoid legal issues.
ANY COPYRIGHT INFRINGEMENT IS THE SOLE RESPONSIBILITY OF THE LICENSEE AND HAS NOTHING TO DO WITH MINITOOL!
6. SOFTWARE IMPROVEMENT PROGRAM
MiniTool Software is committed to always protecting your privacy except as otherwise provided in this Agreement. This statement explains the anonymous data collection process and usage practices for the Software Improvement Program of MiniTool Software.
To provide and improve the software, its features, and user’s experience, we will automatically collect, maintain process and use information concerning the way the various modules and functionalities of MiniTool software are being used. Information is also gathered anonymously for the purpose of statistical analysis about software usage.
We will only use such information for the purpose of providing end users with the best possible software experience. The collected data will not be disclosed, shared, sold, traded, or rented to any third parties for marketing purposes.
The MiniTool Software reserves all rights not expressly granted here.
